No conscious uncoupling for Kristin Cavallari and Jay Cutler, it seems. Despite pledges to Cavallari’s promise on social media that they had come to a “loving conclusion” after a decade together, their divorce papers—and insiders—tell a different story.

‘MARITAL MISCONDUCT’

In papers, the 33-year-old reality star Cavallari accused her 36-year-old ex NHL husband of “marital misconduct.” But what does that mean?

The president of West Coast Trial Lawyers, Neama Rahani told Us Weekly: “ ‘Inappropriate marital conduct’ can include adultery, drug or alcohol abuse, abandoning the marriage, or cruel and inhuman treatment, among other possibilities.”

It can also include desertion for a year, impotence or felony conviction. We will only know what the allegations are, Rahani said, after lawyers gather and present evidence of the “inappropriate marital conduct” to the judge.

The pair share three kids, sons, Camden, 7, and Jaxon, 5 and daughter Saylor, 4. 

CUTLER’S PERSPECTIVE

ET reports that the pair are at each other’s throats behind the scenes because of their handling of the split. 

"Kristin and Jay planned to keep everything amicable, but that's not the case anymore," ET's source revealed. "Kristin filing for primary physical custody upset Jay. He loves his children more than anything and thinks the couple should be reasonable and split custody." And on top of that, "Kristin has made comments about possibly moving back to L.A., which is also a concern of Jay's, as home for the family is currently Nashville," the source added.

She is seeking primary custody, and Cutler is seeking joint.
